1. Agreement and eligibility
These Terms govern the Befona mobile application, website, and related services (the "Service") provided by Befona ("we," "us," or "our"). You must be at least 18 years old and able to form a binding contract. Befona is made for adults and parents and is not directed to children.
You are responsible for accurate account information, securing your sign-in credentials, and activity under your account. Contact support@befona.com if you suspect unauthorized access.
2. Family information and consent
The Service lets you provide names, ages or age ranges, relationships, characteristics, photos, and memories about family members, including children. You confirm that you have all rights, permissions, and consents needed to provide that material and ask Befona and its providers to process it.
Do not upload another person's photo or information when doing so would violate their privacy, safety, intellectual property, or other rights.
3. The Service
Befona provides tools for capturing memories, creating family profiles and avatars, generating and editing illustrated stories and comics, organizing a personal collection, using read-aloud, and sharing selected content. Features, styles, generation costs, processing times, and availability may change.
Some features use generative artificial intelligence. Generated text and images may be inaccurate, incomplete, unexpected, or unsuitable. Review a result before saving, relying on, publishing, or sharing it. Befona does not provide professional advice.
4. Your content
You retain ownership of content you submit, subject to rights held by other people depicted or described in it. You grant Befona a worldwide, non-exclusive, limited license to host, copy, transmit, format, and process that content only as reasonably necessary to provide, secure, support, and improve the Service, fulfill your requests, enforce these Terms, and comply with law.
The license ends when content is deleted from active systems, except where it remains in time-limited backups, was shared by you outside Befona, or must be retained by law. Generated output may not be unique or eligible for copyright protection in every jurisdiction.
5. Acceptable use
You may not use Befona to create, upload, request, keep, or distribute content that:
- sexually exploits or endangers a child;
- is unlawful, threatening, harassing, hateful, defamatory, or deliberately deceptive;
- promotes self-harm, violent wrongdoing, illegal drugs, or dangerous activity;
- contains non-consensual intimate imagery or a harmful impersonation;
- infringes privacy, publicity, copyright, trademark, or another person's rights;
- contains malware, attempts unauthorized access, or disrupts the Service; or
- circumvents content filters, credits, purchase systems, or security controls.
Report inappropriate generated content in the app or at safety@befona.com. We may review reports, remove content, restrict generation, suspend accounts, preserve evidence, or report conduct where reasonably necessary.
6. Credits and one-time purchases
Credits are a limited, revocable license to access specified digital creation features in Befona. They have no cash value, are not property, cannot be transferred, and cannot be redeemed for money.
The app displays current credit costs. Credit packs are consumable purchases processed by Apple App Store or Google Play. Except where required by law or platform rules, completed consumable purchases are non-refundable after credits are delivered or used. Platform refund processes apply.
7. Auto-renewing subscriptions
Befona may offer monthly and yearly auto-renewing subscriptions. Before purchase, the app displays included benefits, credit allowance, localized price, billing period, and any trial or introductory terms.
Payment is charged to your Apple App Store or Google Play account when you confirm. The subscription renews unless canceled through the applicable store before the end of the current period. Manage or cancel it in your store subscription settings.
Deleting Befona or deleting your Befona account does not automatically cancel a store subscription. Cancel it separately to prevent future renewal charges. Subscription benefits and carryover apply only as displayed before purchase.
8. Third-party services
The Service uses providers for sign-in, AI generation, hosting, notifications, analytics, attribution, purchases, speech recognition, and sharing. Services you choose outside Befona are governed by their own terms and privacy policies.
9. Befona intellectual property
The Service, software, branding, design, templates, and Befona-provided content are owned by Befona or its licensors. You receive a personal, limited, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose.
Send intellectual-property notices to legal@befona.com with enough detail for us to identify the work, material, rights holder, and requested action.
10. Suspension, termination, and deletion
You may stop using the Service and request deletion at any time. We may restrict access for a material breach, abuse, legal risk, nonpayment, or a legal requirement. Where appropriate, we will provide notice and a way to contact support.
Delete in Settings > Delete Account or at befona.com/account-deletion. Deletion does not retrieve copies shared outside Befona and does not cancel store subscriptions.
11. Disclaimers and liability
To the extent permitted by law, the Service is provided "as is" and "as available." We do not guarantee uninterrupted operation, permanent storage, a particular generation result, uniqueness, or that every error will be corrected.
To the maximum extent permitted by law, Befona is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages or lost data, profits, or goodwill. Befona's aggregate liability will not exceed the greater of the amount you paid for Befona in the 12 months before the claim or USD 100. Nothing excludes rights or liability that cannot lawfully be excluded.
12. Apple-specific terms
For an iOS app obtained through Apple App Store, these Terms are between you and Befona, not Apple. Apple has no obligation to maintain or support Befona and is a third-party beneficiary entitled to enforce applicable terms. Use is also subject to Apple's App Store Usage Rules and Standard Licensed Application End User License Agreement.
13. Changes
We may update these Terms when law, the Service, security, or our practices change. We will post a new effective date and request consent when required.
